Terms and conditions

These Terms and Conditions (“Agreement”) govern your use of tolsim.com (the “Website”) and purchase/use of eSIM products and related services (“Services”) provided by Skyline Solutions UAB (“we”, “us”, “our”). We act as an eSIM reseller and integrate with third-party telecommunications operators and eSIM platform providers to deliver connectivity. Payment processing is performed by our acquiring/payment partners; we do not ourselves process or store payment card data.

By using the Services, you confirm you have authority to accept this Agreement for yourself or a legal entity.

Eligibility and Accounts

You must be 18+. You are responsible for your account security and all actions under it. We may suspend or terminate accounts for violations or suspected fraud/abuse. We reserve the right to request additional information or verification of identity if required by our payment partners, or in cases of suspected fraud or misuse of our services. Such measures are taken solely to ensure secure transactions and compliance with payment regulations.

Description of Services (eSIM)

3.1. Digital delivery. eSIM is delivered digitally (QR code/eID/eSIM profile). No physical shipment.
3.2. Compatibility. You must use an eSIM-compatible, network-unlocked device. You are responsible for verifying compatibility before purchase.
3.3. Activation and Validity. Activation steps and validity (e.g., days, data allowance, region) are shown at checkout/product page. Validity counts from activation (or as specified).
3.4. Coverage/Quality. Network coverage, speed, latency, and availability depend on third-party operators and may vary by location and time. We do not guarantee uninterrupted service.
3.5. Fair Use / Prohibited telecom behavior. No SIM sharing, reselling, fraudulent/mass activation, traffic pumping, spam/abuse, illegal use, or bypassing technical restrictions. We may suspend or revoke service for violations.

eSIM validity and data allowances are determined by the underlying operator’s system; once activated, data consumption is recorded by the operator’s platform.

Orders, Pricing, Taxes

4.1. Prices are shown at checkout and may change at any time before purchase.
4.2. Applicable taxes (e.g., VAT) are displayed where relevant.
4.3. Order acceptance occurs upon confirmation of payment authorization by our acquiring partner and issuance of the eSIM credentials.
4.4 Prices are inclusive of applicable VAT where required by law. The final price, including taxes, is shown before payment.

Payments and Processing

5.1. Payments are securely processed via our integrated acquiring partners. We do not directly store or have access to full cardholder data. Strong Customer Authentication (e.g., 3-D Secure) may apply.
5.2. For fraud prevention and compliance, our acquiring partner (or we acting on their request) may request identity or payment verification. If verification is not passed, the order may be cancelled and a refund processed according to the partner’s rules.

Delivery and Redemption

6.1. After successful payment authorization, we provide eSIM activation details (QR/eID/profile).
6.2. You must follow the activation instructions. Activation is recorded automatically in the operator’s system, which serves as final confirmation of delivery. (see Refund Policy.).

User Acceptable Use

7.1. Purpose of Use
You agree to use our website solely for purchasing eSIM cards and for receiving related services, including activation and use of the eSIM cards.

7.2. eSIM Card Usage Rules
You agree to use the purchased eSIM cards only for lawful purposes and in accordance with local laws. The use of the product for fraud, illegal activities, or violations of third-party rights is prohibited.

7.3. Payment Processing
All payments for eSIM cards are processed through our acquiring partner, who ensures the security of transactions in accordance with industry security standards, such as PCI DSS. We do not store or process payment card information.

7.4. Prohibited Actions
The following actions are prohibited:

  • Using eSIM cards for unlawful activities.
  • Attempting to interfere with the operation of the website or its services.
  • Violating data protection and privacy laws.

Third-Party Services and Operators

8.1. The Services rely on telecommunications operators, eSIM platform providers, hosting, analytics, and payment partners.
8.2. Your use of connectivity is also subject to the operators’ technical constraints and fair-use rules.
8.3. We are not responsible for third-party terms, outages, or changes outside our control. Where necessary, we will pass through operator notices/constraints.

Refunds, Chargebacks, and Cancellations

9.1. Digital content & withdrawal: By purchasing and requesting immediate delivery or activation of an eSIM, you expressly consent to the immediate performance of the service and acknowledge that the statutory 14-day right of withdrawal under EU consumer law no longer applies once the eSIM has been activated. Activation is automatically recorded in the operator’s system and serves as final confirmation of delivery.
9.2. Before activation: If you have not yet activated the eSIM and wish to cancel your order, you may contact our support team at info@esimee.com within 14 days from purchase. Refund eligibility is subject to confirmation that the eSIM profile has not been activated or downloaded. Proof of non-activation may be required and verified through our upstream service provider’s system.
9.3. After activation: Once an eSIM has been activated or any portion of data has been consumed, refunds are generally not available. Exceptions may apply only in cases where (a) the service could not be technically delivered due to issues verified and confirmed by our upstream provider, and (b) such issues were not caused by device incompatibility, network lock, or local usage restrictions.
9.4. Chargebacks: All refund requests must be submitted in writing to info@esimee.com. Each case is individually reviewed, and eligible refunds will be issued to the original payment method used for the purchase, within a reasonable processing period as permitted by our acquiring partner’s policies.
9.5 Chargebacks and dispute handling:Chargebacks are processed in accordance with the applicable card-scheme rules via our acquiring partner. Initiating a chargeback without first contacting our support team may be considered an abuse of the dispute process. We reserve the right to suspend or terminate accounts that engage in excessive or fraudulent chargeback behavior.

Service Interruptions and Maintenance

We may perform maintenance or implement technical changes from time to time. Service interruptions caused by telecommunications operators, roaming partners, or force-majeure circumstances are not considered our fault or responsibility.

Intellectual Property

All Website content, trademarks, and materials are owned by us or our licensors. No implied licenses are granted.

Warranties and Disclaimers

Services are provided “as is” and “as available”. We do not warrant uninterrupted connectivity, specific speeds, or coverage in any location. Device compatibility and local restrictions are your responsibility unless expressly stated otherwise.

Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect/consequential damages. Our aggregate liability for any claim is limited to the greater of €100 or the total fees you paid to us for the Services in the three (3) months preceding the event.

Nothing in this Agreement limits liability for gross negligence, intentional misconduct, or cases where exclusion is prohibited by law.

Indemnity

You agree to indemnify us against claims arising from your misuse, violations of law, or breach of this Agreement.

Compliance, Sanctions, and Export

You will not use the Services in violation of applicable export controls or sanctions. We may restrict service in certain countries/regions due to legal, regulatory, or operator constraints. We reserve the right to deny activation or terminate service if your transaction or use involves restricted jurisdictions (e.g., sanctioned countries).

Governing Law and Disputes

This Agreement is governed by the laws of Lithuania. Courts of Lithuania have exclusive jurisdiction. The UN CISG does not apply. Consumers retain any mandatory EU consumer rights applicable by law.

Changes to These Terms

We may update these Terms; the updated version will be posted with a new Effective Date. Material changes will be communicated via the Website and/or email where feasible.
